Neutral Citation No. - 2025:AHC-LKO:46146 Court No. - 12 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 7154 of 2025 Applicant :- Sachin Singh @ Amar Singh Rathor (Actual Name Sachin Singh) Opposite Party :- State Of U.P. Thru. Addl. Chief Secy. Home Lko Counsel for Applicant :- Dinesh Kumar Mishra Counsel for Opposite Party :- G.A. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the applicant, learned AGA for the State and perused the record. Supplementary affidavit filed by learned counsel for the applicant is taken on record. In the prosecution case, it is alleged that the applicant, in collusion with the co-accused, was involved in enticing innocent customers and, by using forged documents, selling vacant plots belonging to the Lucknow Vikas Pradhikaran. The specific role attributed to the applicant is that of introducing potential customers to the co-accused.
Learned counsel for the applicant submits that co-accused individuals, namely Rahul Singh, Mukesh Maurya @ Rangi, Dhananjay Singh, Ram Bahadur Singh, and Susheel Kumar Mishra, against whom allegations of forgery were levelled, have already been granted bail by a coordinate Bench of this Court vide orders dated 24.07.2025, 26.06.2025, 02.07.2025, 16.07.2025, and 03.07.2025, passed in Criminal Misc. Bail Applications Nos. 6317 of 2025, 5673 of 2025, 5672 of 2025, 6392 of 2025, and 6169 of 2025, respectively. The applicant seeks parity with the said co-accused. It is further submitted that the only allegation against the
applicant is that he brought prospective customers to the co- accused, who are alleged to have committed the forgery. It is also contended that the applicant’s case stands on a stronger footing than those of the aforementioned co-accused, as there is no direct allegation of forgery against him. The applicant has explained his criminal antecedent of one case. It is further submitted that the applicant is languishing in jail since 28.03.2025. There is no possibility of the applicant of fleeing away after being released from jail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail. Learned AGA has opposed the bail application, however, could not dispute the fact it is a case of parity. On due consideration to the facts that the co-accused who were assigned the role of committing forgery, have already been granted bail; the sole allegation against the applicant pertains to introducing prospective customers to the co-accused; and further taking into account that the applicant is in custody since 28.03.2025, I am of the view that the applicant deserves to be released on bail on the ground of parity. Accordingly, the bail application is allowed on the ground of parity. In case of default of this condition, it shall be open for the trial court to treat it as abuse of liberty of bail and pass orders in accordance with law. (v) The applicant shall remain present before the trial court on each date fixed, either personally or through his counsel. In case of his absence, without sufficient cause, the trial court may proceed against him in accordance with law. (vi) In case, the applicant misuses the liberty of bail during trial and in order to secure his presence proclamation under Section 82 Cr.P.C. (now Section 84 BNSS) is issued and the applicant fails to appear before the court on the date fixed in such proclamation, then, the trial court shall initiate proceedings against him, in accordance with law under Section 174-A IPC (now Section 209 of BNS).
