JUSTICE MITALI THAKURIA ORDER Date : 07-08-2025 Heard Mr. S A B Khabir, the learned counsel for the petitioners. Also heard Mr. P. Borthakur, the learned Additional Public Prosecutor appearing on behalf of State respondent. 2. This is an application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 for granting pre-arrest bail to the petitioners in connection with Abhayapuri P.S. Case No. 131/2025 under Sections 74/189(4)/118(2)/351(2) of BNS, 2023 corresponding to NGR No. 228/2025. 3. Case Diary received. Perused the same. 4. It is submitted by Mr. Khabir, the learned senior for the petitioner that there is a long family dispute between both the parties and on 14.06.2025 some of the persons from the informant side had assaulted the grand-son of the informant and thereafter there was a quarrel between the two groups wherein the informant side armed with some deadly weapon and assaulted the petitioners. Accordingly, they have also lodged an FIR and there was cross case between the parties. He further submitted that the petitioner nos. 19, 20 and 21 have already granted with the interim pre-arrest bail and accordingly they appeared and cooperated in the investigation. The rest of the accused/petitioners are also ready and willing to cooperate the I/O if they are granted with the privilege of pre-arrest bail. Page No.# 7/8 5. Mr. Borthakur, the learned Additional Public Prosecutor submitted in this regard that from the materials in the Case Diary it reveals that there was a quarrel between two groups for viraling photographs of daughter of one of the person from the informant side. But, even after settlement of the dispute, the petitioners assaulted some of the family members of the informant for which the FIR was lodged. However, he submitted that out of 11 injured one of the injured sustained no injury and the other 10 nos. of victim sustained minor injury due to the attack. 6. Considering the materials in the Case Diary and nature of offence, I find that custodial interrogation may not be necessary in the present case and accordingly I find it a fit case to extend the privilege of pre-arrest bail to all the present petitioners and the interim pre-arrest bail granted to petitioner nos. [19] Rabiya Khatun, [20] Rousanara Khatun and [21] Hasina Khatun vide order dated 10.07.2025 is hereby made absolute under the same terms and conditions. 7. Accordingly, it is provided that in the event of arrest of the accused/petitioners, namely, [1] Ashraful Islam [2] Lalchan Ali @ Nanu Miya [3] Rezzak Ali [4] Jahangir Alom [5] Sanjib Ali @ Sojjat Ali [6] Nojor Ali @ Nazar Ali [7] Ojar Ali @ Uzar Ali [8] Fojor Ali [9] Jahidul Islam [10] Baharul Islam [11] Jahidul Islam [12] Amzad Hussain @ Amzad Ali [13] Abdul Jalil [14] Asraful Islam [15] Sanidul Islam [16] Sanowar Hussain [17] Billal Hussain [18] Hasidul Islam [22] Shahjamal @ Shahjalal and [23] Majibar Rahman in connection with Abhayapuri P.S. Case No. 131/2025 under Sections 74/189(4)/118(2)/351(2) of BNS, 2023 corresponding to NGR No. 228/2025, they shall be enlarged on pre- arrest bail on their executing a bond of Rs. 20,000/- (Rupees twenty thousand) only each with one surety of like amount to the satisfaction of the arresting Page No.# 8/8 authority, subject to the following conditions:- (i) that the petitioners shall make themselves available for interrogation by the Investigating Officer within 7(seven) days; (ii) that the petitioners shall fully co-operate with the investigation of the case and shall appear before the Investigating Officer as and when required in connection with the investigation of the aforesaid P.S. case; and (iii) that the petitioners shall not, directly or indirectly, make any inducement, threaten or promise to any person acquainted with the facts of the case so as to dissuade him/them from disclosing such facts to the Court or to any police officer. 8.
