(2) According to petitioner, he is serving as Yoga Instructor (non-teaching) in HNB Garhwal University since 1998. Grievance raised by him is that he is being paid remuneration based on the number of days he is discharging duties and he is not being offered regular salary or minimum of pay scale. By means of this writ petition, petitioner has sought the following relief: “i. Issue a Writ, Order or Direction in the nature of Mandamus directing the respondent no. 2/ University to grant the minimum pay-scale of the post of ‘Instructor’ (Yoga Instructor) as payable as per the Cadre Recruitment Rules, 2019 (Annexure No. 10) to the petitioner.” (3) Learned Counsel for the petitioner submits that petitioner has made representations from time to time to the Vice Chancellor, but no decision is being taken thereupon. (4) Having regard to the facts and circumstances of the case, writ petition is disposed of with liberty to the petitioner to make a fresh representation claiming minimum of pay scale to the competent authority in the University. If he makes representation within two weeks from today, decision thereupon shall be taken, as per law, within eight weeks thereafter.
