Heard the learned counsel for the parties.
2. The petitioner has moved before this Court for grant of privilege of anticipatory bail from apprehending his arrest in connection with Nagri P.S. Case No. 130 of 2024 instituted under Sections 379, 411 of the Indian Penal Code, 54 of JMMC Rule 2004, 4/21 of Mines and Minerals (Development and Regulation) Act 2015 along with Section 7/9/13 of Jharkhand Minerals (Protection of Illegal Mining, Transportation and Storage), Rule 2017.

Learned counsel for the petitioner submits that the petitioner has clean antecedent and his name is transpired in the FIR only on the basis of secret information. The allegation as alleged in the FIR is false and fabricated and the petitioner has not committed any offence. He further submits that the concerned place does not belongs to the petitioner neither the petitioner resides at that locality where the raid was conducted, therefore, he has no concern with the alleged recovery of sand and further more, he has no knowledge about the same.
4. Learned A.P.P. opposed the prayer of the petitioner for grant of bail.
5. Having regard to the facts and circumstances of this case, I am inclined to extend privilege of anticipatory bail to this petitioner. Accordingly, the petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrendering, he will be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rs. Twenty Thousand Only) with two sureties of the like

amount to the satisfaction of learned Judicial Magistrate, 1st Class, Ranchi, in connection with Nagri P.S. Case No. 130 of 2024.
6. It is made clear that petitioner shall co-operate with the investigation / trial. If the petitioner will not co-operate with the investigation / trial, the State would be at liberty to take appropriate action.
