Neutral Citation No. - 2025:AHC-LKO:48431 Court No. - 13 Case :- MATTERS UNDER ARTICLE 227 No. - 4768 of 2025 Petitioner :- Shakeel Ahmad Khan Respondent :- State Of U.P. Thru. Prin. Secy. Home Lko And Another Counsel for Petitioner :- In Person,Ram Kishor Counsel for Respondent :- G.A. Hon'ble Subhash Vidyarthi,J.
1. Heard Sri Ram Kishore, the learned counsel for the petitioner, Sri Arvind Kumar Pandey, the learned A.G.A. appearing on behalf of the State and perused the records.
2. By means of the instant petition filed under Section 227 of Constitution of India the petitioner has sought issuance of a direction to the learned Additional Sessions Judge-IVth, Raebareli for expediting the hearing of petitioner's applications under Section 232 Cr.P.C. and Section 340 Cr.P.C.
3. The complete copy of the order sheet of trial court has not been annexed with the application and therefore this court is not capable of ascertaining the reasons for delay in disposal of applications. The order sheet indicates that the petitioner has requested the trial court on 28.09.2024 that before hearing application under Section 232 Cr.P.C. (Paper No.137-kha) his application under Section 340 Cr.P.C. (Paper No.122-kha) be heard and he had sought further time to enable him to advance his submissions along with the relevant case law.
4. Therefore, it appears that the petitioner himself has requested for adjournment and for not deciding the application Paper No.137-kha. In these circumstances, it does not appear that the trial court is not proceeding with hearing of the applicants with proper expedition. As such, this court finds no good ground to issue any direction to the trial court. The petition lacks merit and the same is accordingly dismissed. .
