The instant bail application has been preferred by the petitioner for grant of regular bail for the offence registered under Section 64(2)(m) of the BNS, 2023. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and the victim has lodged a case against the petitioner that he has committed rape with the victim under the pretext of marriage but on proposal of marriage by the victim, the petitioner refused to solemnize marriage. The informant is a major girl. Further submission has been made that the petitioner is having no criminal antecedent and there is no cogent evidence against the petitioner. He has been languishing in custody since 23.03.2025 4. Learned APP opposed the prayer for bail. 5. Having regard to the facts of the case, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing the bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Latehar in connection with Chandwa P.S. Case No. 64 of 2025. 2025:JHHC:14633 2 6. It is made clear that till commencement of trial, the petitioner shall report to the local police station every month and after commencement of trial, he shall appear on each and every date before the learned trial court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against this petitioner, the learned trial court shall be at liberty to cancel the bail of this petitioner.
