Also heard Mr. K. Baishya, learned Additional Public Prosecutor for the State respondent. This application is filed under Section 483 of the BNSS, praying for granting regular bail to the accused/petitioner in connection with Mayong P. S. Case No. 54/2025, registered under Sections 64(1)/89/318(2)/238/62/351(2) of BNS. The case was listed today for production of the Case Diary before this Court, however, Mr. Baishya, learned Additional Public Prosecutor has submitted that the I.O. has already filed Charge-Sheet in this case, vide Charge-Sheet No. 80/2025, dated 15.07.2025. He accordingly submits that the petitioner may be directed to appear before the learned Trial Court for regular bail. In this regard, Mr. Dutta, learned counsel for the petitioner submits that he want to move an application for regular bail before the learned Trial Court and that the petitioner will appear before the learned Court below and will participate in the trial. Considering the submissions of learned counsels for both sides and also considering the fact that the case has already been Charge-Sheet, vide Charge- Sheet No. 80/2025, dated 15.07.2025, it is provided that the petitioner shall appear before the learned Court below and on his appearance and on his filing a petition for grant of regular bail, the learned Court below shall consider the Page No.# 3/3 same in accordance with law.
