The petitioner has moved before this Court for grant of privilege of anticipatory bail from apprehending his arrest in connection with Korrah P.S. Case No.174/2019 registered for the offences under Sections 356, 382 of the Indian Penal Code. 3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He submits that the petitioner is not named in the FIR and his name has transpired during investigation after five years from the date of commission of offence and he has no concern with the motorcycle which has been used in the commission of offence and also the phone which has been stolen, has not yet been recovered by the police. He further submits that the petitioner is ready to abide by all the terms and conditions as imposed by this Court. 4. Learned A.P.P. opposes the prayer for anticipatory bail of the petitioner. 5. Having regard to the facts of the case and looking to the allegation made against this petitioner coupled with the fact that the petitioner is not named in the FIR; therefore, I am inclined to enlarge this petitioner on anticipatory bail. Accordingly, the petitioner is directed to surrender before the court below within a period of four weeks from today 2025:JHHC:14336 2 and the learned court below on his surrender shall release him on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hazaribag in connection with Korrah P.S. Case No.174/2019. 6. It is made clear that the petitioner shall cooperate with the investigation/trial and if he will not cooperate with the investigation/trial, the State shall be at liberty to take appropriate action.
