JUSTICE BUDI HABUNG ORDER 27.08.2025 Heard Mr. N. Sarma, learned counsel for the applicant. Also heard Mr. S. Ahmed, learned counsel appearing on behalf of Mrs. S. Borpatra Gohain, learned counsel for the respondent No.1; and Ms. L. Sarma, learned counsel for the respondent No.4. This application has been preferred by the applicant praying for substitution of the legal heirs of the deceased respondent No. 1/claimant/deceased, namely Smti. Joonaki Bora. It is submitted by Mr. Sarma, learned counsel for the applicant, that during the pendency of MAC Appeal No. 280/2019, the claimant, Smti. Joonaki Bora, passed away on 21.05.2019. By filing this application, the applicant has prayed for substitution of respondent No. 1/claimant/deceased, Smti. Joonaki Bora, by her legal heirs, namely Ranjana Bora and Sonaram Bora. He further submits that during the pendency of this interlocutory application for substitution, one of the legal heirs, Sonaram Bora, also passed Page No.# 3/3 away. Accordingly, he prays for striking off the name of Sonaram Bora, and submits that the sole surviving legal heir, Ranjana Bora, shall now represent the deceased respondent No.1. The learned counsels appearing on behalf of respondent Nos. 1 and 4 have raised no objection to the same. In view of the above, and in the interest of justice, the interlocutory application for substitution of legal heirs is hereby allowed. Respondent No. 1, deceased Smti. Joonaki Bora, shall be substituted by her sole surviving legal heir, Ranjana Bora, wife of Narayan Bora, Howraghat Road, Near Nilbagan M.E. School, Nilbagan, Hojai, Nagaon, Assam. The name of Sonaram Bora is ordered to be struck off from the list of legal heirs. In terms of the above, the interlocutory application stands disposed of. JUDGE Comparing Assistant
