For the Resp.-State : Mr. Vishwanath Roy, APP --------- 2/03.06.2025 The petitioners apprehending their arrest for the offence punishable under Sections 191(2), 191(3), 190, 127(2), 132, 121 (1), 121(2), 262, 263, 109, 351(3), 352 of the Bhartiya Nyaya Sanhita 2023, have prayed for grant of anticipatory bail. 2. Learned counsel for the petitioners submits that the petitioners having no criminal antecedent are absolutely innocent and has committed no offence as alleged in the First Information Report. He further submits that the petitioners have falsely been implicated in the present due to some ulterior motive of the informant. He further submits that though the petitioners are named in the FIR but the same is on the basis of suspicion as there is general and omnibus allegation against all the accused persons. 3. Learned A.P.P. opposed the prayer for anticipatory bail of the petitioner. 4. Having heard learned counsel for the parties and considering the materials available on record and also the fact that the petitioners are having no criminal antecdent; I am inclined to enlarge the petitioners on anticipatory bail. Accordingly, the petitioners, above named, in the event of their arrest or surrender 2025:JHHC:14333 2 before the court below within four weeks from today, shall be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Madhupur, in connection with Karon P.S. Case No. 23 of 2025, subject to the conditions as laid down under Section 482(2) of the ‘Bharatiya Nagarik Suraksha Sanhita, 2023.’ If the Petitioner will not co-operate in the investigation/trial, the State would be free to take appropriate action available under law.
