Heard learned counsel for the parties. 2. The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 331(4)/305 of the Bharatiya Nyaya Sanhita (B.N.S.), 2023. 3. Learned counsel for the petitioner submits that he has falsely been implicated in this case and for no offence he is languishing in judicial custody since 21.02.2025. Other co-accused persons have already been granted regular bail. As such he may be enlarged on bail. 4. Learned A.P.P. opposed the prayer for bail. 5. Having regard to the facts of the case and also in view of the fact that co-accused persons, namely, Mukesh Kumar Soni and Krishna Soni have already been granted regular bail by a co-ordinate Bench of this Court in B.A. No. 3513 of 2025 and B.A. No. 3728 of 2025 respectively, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- 2025:JHHC:14669 2 (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Garhwa in connection with Garhwa P.S. Case No. 65 of 2025. 6. It is made clear that till commencement of trial the petitioner shall report to the local police station every month and after commencement of trial he shall appear on each and every date before the learned trial court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against the petitioner, learned trial court shall be at liberty to cancel the bail of the petitioner.
