Neutral Citation No. - 2025:AHC-LKO:44607 Court No. - 5 Case :- WRIT - A No. - 8540 of 2025 Petitioner :- K.P.D. Shyamdas Respondent :- U.P. Rajya Sadak Parivahan Nigam U.P. Lko. Thru. Managing Director Counsel for Petitioner :- Manoj Kumar Dubey,Roopani Mishra,Tanzeem Fatima Counsel for Respondent :- Ratnesh Chandra Hon'ble Abdul Moin,J. 1. Heard learned counsel for the petitioner and Ms Aditi Sri holding brief of Shri Ratnesh Chandra, learned counsel for the respondents. 2. By means of the instant petition, the petitioner wants a decision on the appeal dated 29.01.2009, which is said to have been filed by him against his order of termination dated 07.01.2009. 3. Ms Aditi Sri, learned counsel appearing for the respondents states that the Corporation does not have any record of any appeal having been received by it. 4. Considering the aforesaid and the fact that the termination order is itself of 07.01.2009, the petition has been filed after a period 16 years and the only ground taken to explain the laches is that repeated representations were being sent as well as legal notice had been sent, yet keeping in view the law laid down by the Hon'ble Supreme Court in the cases of C. Jacob Vs. Director of Geology and Mining and Another, (2008) 10 SCC 115 as well as Naresh Kumar vs. Department of Atomic Energy reported in (2010) 7 SCC 525 wherein the Hon'ble Supreme Court has categorically held that repeated representations would not extend the limitation, the writ petition is dismissed on the ground of laches.
