This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest in connection with Garhwa P.S. Case No.161 of 2025, for offences under Sections 191(2), 191(3), 329(4), 126(2), 115(2), 118(1), 109, 303(2) and 351(2) of the Bharatiya Nyaya Sanhita, 2023. The case is presently pending before the Court of learned C.J.M. at Garhwa. 3. Learned counsel representing the petitioner submits that all the other co-accused persons in this case save and except this petitioner are on bail. 4. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 5. In view of the submission made by learned counsel representing the petitioner, I direct the petitioner to appear before the Trial Court. On his appearance, the Trial Court will accept the bail bond of the petitioner, since all the other co-accused persons 2025:JHHC:15562 have been released on bail and the case of this petitioner stands on similar footing. 6. It is made clear that the petitioner will cooperate with the investigation, failing which, it will be open to the Investigating Officer to move an application for cancellation of bail of the petitioner. 7.
