OMP (M) No.372 of 2025 The present application has been filed by the appellant/ applicant for condonation of delay in filing the present appeal. It has been averred in the application, especially in Para 2 that the appellant/applicant had engaged M/s Kini Law Firm to challenge the arbitral award before the learned District Judge, Mandi, HP. Thereafter, the engaged counsel vide its legal opinion dated 19.07.2025 had opined that the appellant/applicant should file an appeal against the impugned judgment dated 29.03.2025 and only then the appellant/applicant acquired the knowledge of the passing of the impugned judgment dated 29.03.2025. The said counsel had supplied the certified copy of the impugned judgment dated 29.03.2025, which was applied on 12.06.2025 and the same was delivered on 26.06.2025. It is averred that the delay in filing the present appeal is neither intentional nor willful but the same has occurred due to unavoidable circumstances. In view of the averments made in the application, which is duly supported by an affidavit and taking into consideration the submissions as made by the learned counsel for the appellant/applicant and in view of the no objection by the non- applicants, the present application is allowed and the delay in filing the present appeal is condoned.
