Mr. Naveen Singh Bisht, learned counsel for the Petitioners. 2. Mr. Rakesh Negi, learned Brief Holder for the State. 3. Mr. Prem Prakash Bhatt, learned counsel for Respondent Nos.3 to 7. 4. Present writ petition has been filed by the applicants under Article 226 of the Constitution of India alongwith compounding application and the same is supported with the affidavits of Petitioners and respondent nos.3 to 7. 5. Petitioners as well as respondent nos.3, 4, 5, & 7 are present in the Court whereas respondent no.6-Himanshu Chand (injured) is present through V.C. They are duly identified by their respective counsel. 6. By means of this writ petition, petitioners have sought quashing of the FIR No.211 of 2024 under Section 109, 117(2), 351(2) and 352 of BNS, 2023 registered at Police Station Nanakmatta, District Udham Singh Nagar. 7. Learned counsel for the parties have filed their respective affidavits along with the compounding application stating therein that they do not wish to pursue the present criminal case any further and a compromise has been entered between them. 8. Learned State counsel objected the compounding application and submits that in the instant matter the injured sustained serious injuries. He submits that as per FIR the assailants inflicted injuries on the injured by a sharp edged object and with the butt of a country made pistol. During the incident respondent no.6-Himanshu Chand and
respondent no.7-Sonu Bhatt tried to intervened, they were also assaulted; Himanshu Chand also sustained serious injuries on the head while Sonu Bhatt got internal injuries. 9. After interacting with the parties specially with injured persons they state that they do not wish to pursue the matter any further. 10. Heard learned counsel for the parties and perused the material available on record. 11.
In view of the principle of law laid down by Ho’ble the Apex Court in the case of Gian Singh vs. State of Punjab reported in 2012 (10) SCC 303, criminal proceedings can be quashed by this Court, if this Court is satisfied that matter has been settled between the parties amicably and parties are interest to restore peace and harmony between them. 12. Having heard learned counsel for the parties and in view of the above, the compounding application is allowed. The FIR No.211 of 2024 under Section 109, 117(2), 351(2) and 352 of BNS, 2023 registered at Police Station Nanakmatta, District Udham Singh Nagar is hereby quashed. 13. Accordingly instant criminal writ petition stands disposed of. (Ashish Naithani, J.)
