The instant bail application has been preferred by the petitioner for grant of regular bail in connection with Madhuban PS Case No. 08 of 2025, registered for the offence under Sections 303(2)/317(5)/3(5) of BNS, Sections 4/21 of the MMDR Act, Sections 4/54 of JMMC Rules and Sections 7/9/13 of JMPIMTS Rules. 3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case due to ulterior motive and no incriminating article has been recovered or seized from the physical and personal possession or from the house of the petitioner. He submits that the co-accused, namely, Mantu Yadav, Rahul Yadav @ Prachi @ Rahul Kumar, Binod Sharma, @ Binod Kumar Sharma and Rocky Modak @ Tapas Modak @ Tapas Kumar Modak have been granted bail in A.B.A No. 2885 of 2025 by a Co-ordinate Bench of this Court. He further submits that petitioner is in custody since 30.01.2025 as such, the petitioner may be enlarged on bail. 4. Learned APP opposes the prayer for bail. 2025:JHHC:14461 2 5. Having regard to the aforesaid facts and circumstances, I am inclined to enlarge the petitioner on bail and accordingly, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned J.M.F.C, Dhanbad, in connection with Madhuban PS Case No. 08 of 2025. 6. It is made clear that the petitioner shall appear on each and every date before the learned trial Court and he shall not threaten any witness and shall cooperate in trial and if any adverse report will come against this petitioner, learned trial Court shall be at liberty to cancel the bail of this petitioner.
