The instant bail application has been preferred by the petitioner for grant of regular bail in connection with Borio PS Case No. 61 of 2021, registered for the offence under Sections 147, 148, 149, 323, 325, 341, 353, 307, 332, 333, 411, 427, 379, 224, 225 and 120(B) of the Indian Penal Code.

Learned counsel for the petitioner submits that the FIR has been registered against more than 300 unknown persons. He submits that the petitioner has no connection with the alleged incident and his name is dragged in this case because the petitioner resides near the place of occurrence. He submits that the co-accused, namely, Kailash Kumar Sah @ Kailash Sah, Sufal Tudu, Anil Pandit, Surya Narayan Hansda @ Surya Hansda @ Suiya Naiaya Hado in ABA No. 5271 of 2021, ABA No. 1965 of 2022, BA No. 8995 of 2021 and BA No. 9187 of 2021 respectively, have been granted bail by a Co-ordinate Bench of this Court and the petitioner is in custody since 19.03.2025. As such, he submits that the petitioner may be enlarged on bail.

Learned APP opposes the prayer for bail.

Having regard to the aforesaid facts and circumstances, I am inclined to enlarge the petitioner on bail and accordingly, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Sahibganj, in connection with Borio PS Case No. 61 of 2021.

It is made clear that the petitioner shall appear on each and every date before the learned trial Court and he shall not threaten any witness and shall cooperate in trial and if any adverse report will come against this petitioner, learned trial Court shall be at liberty to cancel the bail of this petitioner.
