Neutral Citation No. - 2025:AHC-LKO:45193-DB Court No. - 1 Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 790 of 2025 Petitioner :- Ashwini Kumar Respondent :- Union Of India Thru. Its Ministry Of Road Transport And Highways New Delhi And 5 Others Counsel for Petitioner :- In Person Counsel for Respondent :- A.S.G.I.,C.S.C.,Namit Sharma,Vivek Pandey Hon'ble Rajan Roy,J. Hon'ble Manish Kumar,J. The petitioner, a practicing Advocate of this Court has filed the Public Interest Litigation raising issues pertaining to road accidents in India. We have gone through the pleadings. No doubt, the petitioner has referred certain reports of the Ministry of Transport revealing the number of accidents which have taken place, details of which has been mentioned in para 22. The writ petition is silent as to whether the Ministry of Transport, Govt. of India or for that matter, the concerned Ministry at the State Level have failed to take any steps to remedy the problem as far as possible. The petitioner should have sought information from the concerned Ministry as to what are the measures put in place for reducing such accidents and the awareness campaign, if any, required, whether that has been undertaken or not and only if he found that the Government whether it be at the Centre or the State, is apathetic to the problem, a cause would have arisen to file this Public Interest Litigation. Nevertheless, the petitioner is granted liberty to approach the Ministry concerned whether at the Centre or the State Government raising his grievance and making his suggestions to remedy the problem. As regards the grievance of the petitioner that the roads supposed to be maintained by the Nagar Nigam are not properly maintained resulting in accidents, we grant him liberty to approach the Commissioner, Municipal Corporation, Lucknow pointing out the discrepancies in the services which are supposed to be provided by the Corporation statutorily whereupon the said Ministries/Corporation shall look into the matter and do the needful. Petition stands disposed of accordingly. At this stage, the petitioner submitted that the road accidents in India report which was published in the year 2022 is no long being published by the Ministry of Transport, Govt. of India. This grievance can also be raised by the petitioner before the concerned Ministry or if otherwise permissible seek information in this regard as to the reasons for the aforesaid under the Right to Information Act and then take adequate steps.
