Cr.MP No. 1222 of 2025 Heard. 2. Learned counsel for the respondent, under instructions, submits that he has no objection in case the present application is allowed. In view of this submission, present application is allowed and the delay in filing the revision is ordered to be condoned. 3. The present application stands disposed of. Cr. Revision No. _____ of 2025 (Cr. Revision-ST No. 4492 of 2025). 4. Notice. Mr. Suneel Awasthi, learned counsel appears and waives service of notice on behalf of the respondent. 5. The delay in filing the revision petition has been condoned vide separate order passed in Cr.MP(M) No. 1222 of 2025. Petition be registered. 6. Copy of the petition be supplied to learned counsel for the respondent. Cr.MP No. ____ of 2025 Cr.MP (ST No. 4493 of 2005 7. Notice in the aforesaid terms. 8. Learned counsel for the respondent, under instructions submits that he does want to file any reply to the application and has no objection in case the application is allowed. 9. It is stated that the applicant/petitioner is lodged in jail. Keeping in view the nature of the offence punishable under Section 138 of the Negotiable Instruments Act and no objection conveyed by the learned counsel for the respondent, execution and operation of the substantive sentence of imprisonment awarded by the learned Trial Court on 17.8.2023, as affirmed by the learned Appellate Court on 3.5.2025, in Criminal Appeal No. 62 of 2023, is ordered to be suspended and he be released, if not required in any other case, subject to furnishing of personal and surety bonds in the sum of ₹25,000/- each to the satisfaction of the learned Trial Court, with an undertaking to appear and serve sentence, in case of dismissal of the present revision, within a period of one month from today. A copy of this order be sent to the learned Trial Court for information and necessary action through FASTER. 10. The applicant/petitioner is permitted to produce copy of this order, downloaded from the Webpage of the High Court of Himachal Pradesh before the authorities concerned and the said authority shall not insist on the production of a certified copy but if required, may verify from passing of the order from website of the High Court of H.P. 11. The bail bonds, so furnished by the applicant/petitioner be transmitted to this Court for placing the same on record. 12. A copy of this order be sent to the learned Trial Court for information.
