The instant appeal is reported to be barred by one day. The Court has considered the cause shown in the application accompanying application seeking condonation of delay and finds cause has been simply explained hence application shall stand allowed and appeal shall be treated to have filed within time. Learned counsel for the appellant has very fairly pointed out that the issue involved in the instant appeal was raised by the present appellants in a bunch of three appeals bearing No.26 of 2022 and 27 of 2022 and 8 of 2022 and all the three appeals were heard and decided by a coordinate Bench of this Court by means of the order dated 05.07.2022 dismissed all the three appeals. The appellant further escalated the matter before the Apex Court, however, the Special Leave Petitions were also dismissed by the Apex Court vide order dated 18.05.2023. Considering the fact that the issue raised has already been considered and decided by this Court vide judgment dated 05.07.2022 which has attained finality as SLP of the appellant has been dismissed. This appeal in terms of the judgment dated 05.07.2022 passed in RERA Appeal No.26 of 2022 is dismissed.
