Neutral Citation No. - 2025:AHC-LKO:44754 Court No. - 5 Case :- WRIT - A No. - 8593 of 2025 Petitioner :- Tejendra Kumar Shukla And 90 Others Respondent :- State Of U.P. Thru. Prin. Secy. Basic Education Lko. And 13 Others Counsel for Petitioner :- Surya Narayan Mishra Counsel for Respondent :- C.S.C.,Avinash Singh Vishen,Uday Veer Singh Hon'ble Abdul Moin,J.
1. Heard Surya Narayan Mishra, learned counsel for the petitioners, Sri Nitin Mathur, learned Additional Chief Standing Counsel appearing for the respondent No.1, Sri Avinash Singh Vishen as well as Sri Ashish Shukla, learned counsel appearing for the respondents No.2 to 7 and Dr. Udai Veer Singh, learned Additional Chief Standing Counsel appearing for the respondents No.8 to 14.
2. The petitioners, who are all Shiksha Mitras, are aggrieved by the orders by which they have been appointed as Booth Level Officers (BLOs).
3. The contention of learned counsel for the petitioners is that the Election Commission of India has issued a communique dated 05.06.2025, a copy of which is Annexure-3 to the petition. As per the said order, the petitioners would fall within the ambit of clause 1.2, who can be made BLOs, provided the regular State/Local Government employees are not available, for which a non-
availability certificate signed by the Electoral Registration Officer (ERO) and countersigned by the District Election Officer (DEO) is to be given.
4. It is contended that, without complying with the communique dated 05.06.2025, the orders impugned have been passed whereby the petitioners have been nominated as BLOs.
5. On the other hand, Sri Avinash Singh Vishen,
learned counsel appearing for respondents No. 2 to 7, states on the basis of instructions dated 31.07.2025 signed by the Deputy Election Officer, Gonda, that the communique dated 05.06.2025 has been fully complied with and the non- availability certificate signed by the Electoral Registration Officer (ERO) and countersigned by the District Election Officer (DEO) was submitted, and only thereafter have the petitioners been assigned duty as BLOs.
6. The aforesaid statement is recorded.
7. The writ petition is, accordingly, disposed of. [Abdul Moin, J.]
