Learned counsel appearing for the applicant submits that the statement of the Malkhana Mohrir was recorded and he was cross examined,whereas he was not a witness of any act of offence. He added that the opportunity of hearing for cross- examine the Investigating Officer on this issue, was not accorded by the learned trial court and therefore, an application under section 311 of Cr.P.C. was moved and that was rejected by the learned trial court without any cogent reason. After the aforesaid arguments, learned counsel appearing for the applicant submits that he may be permitted to withdraw the instant application. Learned counsel for the State has no objection to the contention aforesaid. In view of the aforesaid submissions, the instant application is dismissed as withdrawn. Consigned to records.
