Heard learned counsel for the petitioners and Shri Manish Mishra, learned counsel for the Lucknow Development Authority. The present writ petition has been filed by the petitioners challenging the order dated 10.08.2023 passed under section 27(1) of U.P. Urban Planning & Development Act, 1973 as well as the order dated 29.08.2024 whereby the appeal preferred was dismissed and the order dated 07.07.2025 whereby the revision preferred was also dismissed. The submission of the counsel for the petitioners is that although the petitioners had applied for sanction of the layout plan but no order was passed thereupon and the same is still pending. Counsel for the respondent states that the pending application for grant of layout plan could be processed in accordance with law. Considering the said submissions, no interference is called for in the impugned order, however directions are issued to consider the application filed by the petitioner for sanction of the layout plan in accordance with law within a period of two months from today.. It is clarified that the application for sanction of the layout plan shall be decided without being influenced by any of the orders impugned herein. Subject to sanction of layout plan, the petitioners would be entitled to raise the construction over the property in question. Needless to add that the requirements as are specified shall be fulfilled by the petitioners and the amount deposited shall also be taken into consideration while considering the layout plan.
