Heard learned counsel for petitioner and learned State counsel for opposite parties. 2. Petition has been filed seeking the main reliefs:- (i) Issue a writ, order or direction in the nature of Mandamus commanding the opposite parties to revised the post retiral benefits of the petitioner granting the selection grade and ACP as per Government Order dated 04.05.2010 read with corrected Government Order dated 29.09.2010 (contained as annexure no.4 to the writ petition). (ii) Issue a writ, order or direction in the nature of Mandamus commanding the opposite parties to pay the arrears of salary and pension not paid due to not extension of benefits of selection grade scale and ACP. 3. Since consideration of petitioner's grievance would entail factual aspects, without entering into merits of the case, liberty is granted to petitioner to move a fresh representation before opposite party No.1 i.e. Principal Secretary, Medical Health & Family Welfare Department, Civil Secretariat, Lucknow. In case such a representation is filed, the same shall be decided within period of eight weeks from the date a certified copy of this order is produced before the said authority. 4. With the aforesaid directions, the writ petition stands disposed of.
