1. That Appellants 1 to 3 and Respondent Nos. 6 & 7 have compromised the First appeal with the below mentioned terms and conditions. 1^‘ Respondent / 1®' Defendant died and his legal representatives were brought on record as Respondent Nos. 6 & 7. The Appellants and Respondent Nos. 6 & 7 have prepared a sketch which includes Item Nos. 1,2 and 3 of Plaint Schedule Property. That Both the Appellants and Respondent Nos. 6 & 7 have agreed that there are 2 shops on Southern side abutting road and there is a 4 feet width pathway in between 2 shops from South to No.dh.
On the back of the said two 2 shops there are 4 shops which are covered under Items 2 and 3 of Plaint Schedule Property. Apart from that there is a house on upper floor of Item No.1 to 3 i.e., where Respondent Nos. 6 & 7 are residing. There are steps to reach 1®' Floor on South-east corner, to give more brevity, a sketch was prepared for easy understanding. In the rough sketch, 2 shops are shown as 1. ABCD shop situated on South west and another shop EFGH on south east in between there is 'CBEH' pathway to reach Northern shops. The elders have compromised the matter in between the Appellant Respondent Nos. 6 & 7
2. i I Nos.1 to 3 and That Appellants and Respondent Nos. 6 & 7 have agreed that Appellants have to hold ABCD and as EFGH (2 shops) with absolute rights for which Respondent Nos. 6 & 7 have no objection. A. / \ 00 A Vi'- 1 I s
-^/i- The Appellant Nos. 1 to 3 have also agreed to keep ‘CBEH’ Pathway for the benefit of Respondent Nos. 6 & 7 and Appellants have no objection r; B. / exclusive and claim in respect of upstairs over Item No.1 of Plaint Schedule Property used by respondents 6 and 7 as an exclusive owners. It is further agreed that the AppeHants will not claim any share in respect of Item No. 2 or 3 Plaint Schedule Property as like upstairs house situated over and above Item No.1 Schedule Property and they will not interfere with the exclusive use of Plaint of stair case of Respondent Nos. 6 and 7 to reach upstairs. Appellant Nos.
1 to 3 and Respondent Nos.6 and 7 who are legal heirs of Respondent No.1/ Defendant No.1 i.e., elder brother of 1®‘ Appellant will object the enjoyment of Item 1 (2 shops) of the Plaint Schedule Property ‘ABCD’ and ‘EFGH’ C. The not which are clearly mentioned in the annexure sketch as 2 shops. It is further submitted that the Pathway mentioned as CBEH is Defendant Nos. 6 and 7/ Respondent Nos. 6 and 7 decided to use by exclusively and absolutely and the appellants shall not claim any right over ‘CBEH’ pathway. The Appellants/Plaintiffs are hereby agreed that they will not claim any right the back side of said 2 shops (ABCD and EFGH) as well as mesne profits. D. on For which the Respondent Nos. 6 and 7 are hereby agreed to pay an amount towards full and final settlement of First Appeal claim in of Rs.8,00.000/- A.S.Nos.236/2013 and 796/2013 to the 1"‘ Appellant (Jupudi Satyanarayana). Out of Rs.8,00.000/- today an amount of Rs.4.00,000/- was paid by way of HDFC Bank. The said 3 shops are on western side, which are not part of thr:^laint^ Schedule Property and there is no dispute to the said 3 shops situated on western side as well as two (2) shops of Respondent Nos. 6 and 7. F. The Respondent Nos.6 and 7 shall not interfere with the possession and enjoyment of Item No.1 ( 2 shops ABCD and EFGH Shops ).
The appellants shall not interfere with the possession and enjoyment of the rest of the property including the up stair residential house and the steps. G. In view of the compromise in this appeal, the appeal in A.S.No.796 / 2013, and C.R.P.No. 1262/2022 are to be closed by recording the compromise terms of this appeal. H. The respondents 6 and 7, being the legal heirs of the deceased 1®' respondent are entitled to take the original title deeds Ex:B5 and B6 back marked in O.S. No.41/2010 on the file of XI Addl. District Judge, Gudiwada. The respondents 6 and 7 have to hand over the Ex: B5 sale deed Doc. bearing No.89/1987 S.R.O. Gudiwada to the 1"‘ appellant. I. Both parties agreed to execute and register the partition deed in terms of the compromise decree and do bear the expenses equally for registration of the partition deed. The appeal suit and I.A.No.1 of 2025 coming this day for order as to settlement in the presence of Sri Narasimha Guidseva, Advocate for the Appellants and of Sri B V Anjaneyulu, Advocate for respondent Nos. 6 & 7.
Appellant and the Respondents through respective advocate having filed I.A.No.1 of 2025 requesting the court to pass decree in terms of Memorandum of Compromise entered into between them and upon perusing the grounds of appeal, Judgment and decree of the Trial Court and the Joint Memorandum of Compromise purporting to have been signed by the parties and their advocates and filed with the said I.A.No.1 of 2025, it is appearing from the said Memorandum of compromise that the parties herein have entered into compromise and settled the matter in terms of compromise filed in I.A.No.1 of 2025. This Court DOTH RECORD the terms of the said Joint Memorandum of Compromise the original where is filed in the record of the said I.A.No.1 of 2025 and a copy whereof is annexed hereto and Doth in terms of the said Memorandum of Compromise, order and decree as follows:
1. That the appeal be and is hereby disposed of; That the terms and conditions of the compromise enetered into between parties herein as follows: That the Appellants 1 to 3 and Respondent Nos. 6 & 7 have compromised the First appeal with the below mentioned terms and conditions. 1
2. I. Respondent/1 Defendant died and his legal representatives were brought on record as Respondent Nos. 6 & 7. That the Appellants and Respondent Nos. 6 & 7 have prepared a sketch which includes Item Nos. 1, 2 and 3 of Plaint Schedule Property. It is further agreed that the Appellants will not claim any share in respect of Item No. 2 or 3 Plaint Schedule Property as like upstairs house situated over and above Item No.1 of Plaint Schedule Property and they will not interfere with the exclusive use of stair case of Respondent Nos. 6 and 7 to reach upstairs. C. That the Appellant Nos. 1 to 3 and Respondent Nos.6 and 7 who are ’ legal heirs of Respondent No.1/ Defendant No.1 i.e., elder brother of 1st Appellant will not object the enjoyment of Item 1 (2 shops) of the Plaint Schedule Property which are clearly mentioned in the annexure sketch as 'ABCD' and 'EFGH 2 shops. It is further submitted that the Pathway mentioned as 'CBEH' is decided to use by Defendant Nos. 6 and 71 Respondent Nos. 6 and 7 exclusively and absolutely and the appellants shall not claim any right over 'CBEH' pathway.
D. That the Appellants/Plaintiffs are hereby agreed that they will not claim any right on the back side of said 2 shops (ABCD and EFGH) as well as mesne profits. For which the Respondent Nos. 6 and 7 are hereby agreed to pay an amount of Rs.8,00,000/- towards full and final
settlement of First Appeal claim in A.S.Nos.236/2013 and 796/2013 to the 1st Appellant (Jupudi Satyanarayana). Out of Rs.8,00,000/- today an amount of Rs.4,00,000/- was paid by way of Cheque No.000037 Dt. 22-12-2024 drawn on HDFC Bank. In the name 1st Appellant /1st Plaintiff which is to be presented for collection immediately after recording the compromise, and Respondent Nos.6 and 7 have agreed to pay Rs.4,00,000/- on the date of Registration of partition deed in terms of Compromise Decree. That it is relevant to mention that there are 3 shops abutting to park road on Western side on South-West corner shop belongs to the Appellants as like other 2 shops are belonged to Respondent Nos. 6 and 7/Defendant Nos e and 7. The appellants shall not interfere with the possession and enjoyment of the rest of the property including the up stair residential house and the steps. G. That In view of the compromise in this appeal, the appeal in A.S.No.796/2013, and C.R.P.No.1262/2022 are to be closed by recording the compromise terms of this appeal. H. That the respondents 6 and 7, being the legal heirs of the deceased 1 respondent are entitled to take the original title deeds Ex:B5 and B6 back marked in O.S. No. 41/2010 on the file of XI Addl. District Judge, Gudiwada. The respondents 6 and 7 have to hand over the Ex: B5 sale deed Doc bearing No.89/1987 S.R.O. Gudiwada to the 1®‘ appellant.
I. That the both parties agreed to execute and register the partition deed in terms of the compromise decree and do bear the expenses equally for registration of the partition deed. That the terms and conditions are all binding on both the parties and their legal heirs and successors. That there be no order as to costs in this appeal. J.
