This is an application, filed by respondent No. 4/applicant-herein seeking modification of the judgment dated 3rd January, 2025 passed by this Court in WP(C) No. 32/2025 titled as “Gurcharan Singh versus UT of J&K and Ors.” on the ground that it has been passed without affording an opportunity of being heard to respondent No. 4/applicant and, therefore, untenable in the eye of law. 2. It is submitted by the learned counsel for respondent No. 4/applicant that since this Court has not fixed any time-frame for filing the revision petition before the Financial Commissioner, as such, the petitioners-herein took advantage of the situation and chose not to file any revision petition with a view to enjoy the benefit of interim protection granted by this Court. 3. Having heard learned counsel for the parties, I find prima-facie substance in the submissions made by learned counsel for the respondents. 4. Issue notice to the non-applicant, returnable within four weeks. Requisites for service within two weeks. Sr. No. 2 -2- 5. List on 21.11.2025. 6. In the meanwhile, subject to objections and till the next date of hearing, the judgment dated 03rd January, 2025 passed by this Court in WP(C) No. 32/2025 shall remain in abeyance.
