Heard learned counsel for the parties.
2. The petitioner has moved before this Court for grant of privilege of anticipatory bail for the offence instituted under Sections 126, 115 & 109 of the B.N.S., 2023.

Learned counsel for the petitioner submits that the petitioner is a B.C.C.L. employee and he has falsely been implicated in this case as alleged in the F.I.R. There was a land dispute between the parties and due to previous enmity the petitioner has been implicated. It has further been submitted that during the investigation, witnesses examined are hearsay and interest witnesses and they are not eye witness to the occurrence.
4. Learned A.P.P. has opposed the prayer for anticipatory bail.
5. Having regard to the facts of the case, I am inclined to grant the privilege of anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender in the Court below within four weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Dhanbad in connection with Katras (Ramkanali O.P.) P.S. Case No. 204/2024 with the condition that he will co-operate with the investigation of the case and appear before the investigating officer as and when noticed by him and furnish his mobile number and photocopy of the Aadhaar Card with an undertaking that he will not change his mobile number during the pendency of the case and

subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. It is made clear that if the petitioner does not cooperate with the investigation/trial, the State would be at liberty to take appropriate action.
