Issue a writ, order or direction in the nature of Habeas Corpus commanding and directing to the opposite party no. 2 & 3 to produced the Petitioners/Deteneue from the illegal custody of opposite party no.4 & 5, and they may be set at liberty under the care and custody of applicant/mother of applicant." Considered the fact that petitioner, living in Saudi Arabia since November 2024, has filed the present petition seeking the custody of minors namely Ms. Arvi Gupta aged about 9 years and Ms. Arushi Gupta aged about 7 years, who are living in India with Mrs. Priya Gupta alias Priyanka, mother of minors and wife of petitioner, as also the fact that the affidavit filed in support of present petition has been filed by Mrs. Neelam Gupta wife of Sri Shiv Kumar Gupta (mother of the petitioner) based upon the Vakalatnama received through courier from Saudi Arabia. Upon due consideration of the fact, on being confronted, the learned counsel for the petitioner submits that he does not want to press the present petition and the same may be dismissed as withdrawn. To the aforesaid prayer, learned AGA has no objection. Accordingly, the present petition is dismissed as withdrawn.
