Today when the petition is taken up for hearing, learned Assistant Public Prosecutor has produced a copy of instructions of the Inspector of Police, Krishna Lanka Police Station, Vijayawada City, wherein it is stated that pending the present petition, the Police, after due investigation have filed a charge sheet vide C.C.No.1438 of 2023 dated 29.12.2023, on the file of the II Additional Metropolitan Magistrate Court, Vijayawada and the case was in pre-trial and is posted to 20.03.2025. 3. In view of the fact that on 29.12.2023, a charge sheet vide C.C.No.1438 of 2023, has already been filed, pending the present petition, learned counsel for the petitioner sought permission of this Court to withdraw the present petition. 4. Permission as sought for is accorded. Accordingly, this criminal petition is dismissed as withdrawn, with a liberty to challenge the aforementioned charge sheet, if at all the petitioner is aggrieved by the same.
