The instant application under section 482 Cr.P.C./528 of the B.N.S.S.,2023 has been filed with the prayer to direct the opposite parties no. 2 to 4 to conduct denovo investigation against the final report dated 19-04-2025 in Case Crime No. 039 of 2024, under section 302 of the I.P.C., Police Station-Gaura Chauraha, District-Balrampur and also to direct the opposite party no. 2 to consider the representation letter, which is annexed as Annexure No. 8 to this application. Learned counsel appearing for the applicant submits that the protest application has still not been filed. He further submits that the opposite parties no. 2 to 4 may be directed to conduct denovo investigation against the final report dated 19-04-2025 in Case Crime No. 039 of 2024, under section 302 of the I.P.C., Police Station-Gaura Chauraha, District-Balrampur. The aforesaid contentions of learned counsel for the applicant have vehemently been opposed by the learned counsel for the State. Considering the submissions of learned counsel for the parties, particularly, the admission on the part of the applicant that no protest application has been filed as yet, this court finds no merit in this application. Ergo, it is hereby dismissed with liberty to the applicant to take appropriate steps, as provided under the law.
