Respondent Petition under Sections 480 & 483 of BNSS (Old Sections 437 & 439 of Cr.P.C), praying that in the circumstances stated in the affidavit filed in support of the Criminal Petition, the High Court may be pleased to enlarge the Petitioner/Accused No.6 on bail pending disposal of Crime No.42/2025 of Anakapalli Rural P.S., now Anakapalli District. The petition coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of Sri BOOSARA V N PRAVEEN KUMAR, Advocate for the Petitioner and of PUBLIC PROSECUTOR for the Respondent and the Court made the following; 1. The Criminal Petition has been filed under Sections 480 and 483 of the Bharat-Iya Nagarik Suraksha Sanhita, 2023 (for brevity zthe BNSS'), Seeking tO enlarge the Petitioner/A6 on ba" in cr.No.42 of 2025 on the file Of Anakapalli Rural Police station, Anakapalli, registered against the PetitiOne/A6 herein for the offence punishable under sections 20(b)(ii)(B), 25 read with 8(c) of the Narcotic DrllgS and PsychOtrOPiC Substances Act, 1985 (for brevity {the NDPS Act'). 2. The case Of the Prosecution in nutShe" iS that On 22.02.2025 the Sub-Inspector Of Police, Anakapa[li Rural Police station, Anakapalli, received information about the illegal pos'session and transportation of ganja. He secured the Presence of mediators and rushed to Kunchangi Village Junction of Anakapalli Mandal and COnduCted Vehicle Check, Where he noticed six persons. The Sub Inspector Of Police along with his staff apprehended Al to A5 and 1 CICL and se]Zed 8 kgs of ganja under the cover of mediators report, on o2,04.2025, the Sub_ Inspector of police received information about the absconding accused (A6), secured mediators, rushed tO Sunkarametta Junction, Anakapalli Village and apprehended A6 while he tried to escape- 3. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 4. Learned counsel for the petitioner submits the r,.. petitioner has not committed any offence; pe{i{ioner was falsely implicated by the police in the crime; petitioner would abide by any conditions to be imposed by this Court; and urged to allow the petition. 5. Per cot,ira, the learned Assistant Public Prosecutor, opposed the bail application stating that some more material witnesses have to be examined; investigation is not completed; if the petitioner is enlarged on bail, he would not be available for the investigation and he would escape from the clutches of law; and urged to dismiss the bail petition. 6. As seen from the record, the petitioner has been in the judicial custody for the past 64 days. The petitioner is resident of Balda Village, Padua Tehsil, Koraput District, Odisha State. lf the petitioner is enlarged on bail with stringent conditions, he would not flee away from the clutches of the law, and interest of the justice would be served. 7. Keeping in view of the period of detention undergone by the petitioner in judicial custody for more than 64 days, the nature and gravity of allegations leveled against the petitioner, a-.-, and his alleged role in this case, this Court is inclined to enlarge the petitioner on bail with the following stringent conditions. 8. In the result, the criminal petition iS allowed With the following conditions:- (i) The petitioner/A6 shall execute personal bond for Rs.10,00O/-(Rupees Ten Thousand Only) with two sureties for like sum to the satisfaction of learned I Additional District and Sessions Judge - Special Judge for {ria' of offences under NDPS Act, Visakhapatnam. (ii) The petitioner/A6 is directed to appear before the Station House Officer, AnakapaI'i Rural Police station, Anakapalli, on every 2nd Saturday and 4th Saturday between 10.00 a.m. to 05.00 p.m., till filing of the charge sheet. As a sequel, pending applications, if any, shall stand closed.
