W.P.(MD)No.21350 of 2025 BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED : 05.08.2025 CORAM: THE HONOURABLE MR.JUSTICE C.SARAVANAN W.P.(MD)No.21350 of 2025 and W.M.P.(MD)Nos.16476 and 16477 of 2025 M.Thiruvalluvan ... Petitioner -vs- 1.The Regional Transport Authority cum District Collector, Tiruchirappalli District, Tiruchirappalli. 2.The Regional Transport Officer, Trichy West, Trichy District. ... Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned order issued by the first respondent vide his proceedings in Se.Mu.No. 50337/A2/2024 in Order No.7, 2nd Para (Town Bus Service) dated 14.07.2025 and quash the same as illegal and consequently, to direct the respondents to permit the petitioner to operate his Stage Carriage bearing Registration No.TN-45-AB-0365 from Central Bus Stand Panjapur Kalaignar Bus Stand (via) Mannarpuram. For Petitioner : Mr.A.C.Asaithambi For Respondents : Mr.D.Ghandiraj Special Government Pleader ____________ https://www.mhc.tn.gov.in/judis W.P.(MD)No.21350 of 2025 ORDER The petitioner has challenged the impugned communication issued by the first respondent, dated 14.07.2025, bearing Reference No.Se.Mu.No. 50337/A2/2024. 2. By the impugned order, insofar as Town Buses are concerned, it has been stated as follows:- ''efug; NgUe;Jfs; kj;jpa NgUe;J epiyaj;ij Kidakhff; (Terminus) nfhz;L ,aq;Fk; midj;J efug; NgUe;JfSk; kj;jpa NgUe;Jepiyak;> kd;dhu;Guk; topahf gQ;rg;G+u; gQ;rg;G+u; fiyQu; xUq;fpize;j NgUe;J Kidaj;jpw;F nry;y Ntz;Lk;. ,it gQ;rg;G+u; fiyQu; xUq;fpize;j NgUe;J Kidaj;jpypUe;J ,Nj topjlj;jpy; jpUk;gr; nry;yNtz;Lk;.'' 3. The impugned order states that all buses operating with the Central Bus Stand as their terminus must proceed to the Panjapur Kalaignar Integrated Bus Stand via Mannarpuram and return via the same route. It has further directed that all buses departing from the bus terminal (except those bound for Madurai) should use the National Highway up to Panjapur Junction and then take a U-turn. ____________ https://www.mhc.tn.gov.in/judis W.P.(MD)No.21350 of 2025 A reference is also made to G.O.(Ms)No.48, Home (Transport – VII) Department, dated 28.01.2018, which was issued in respect of all City and Sub-Urban buses operating via the route to the Panjapur Kalaignar Integrated Bus Terminal. 4. The case of the petitioner is that, due to the opening of the new Panjapur Kalaignar Bus Stand and the demolition of the Tiruchirapalli Central Bus Stand, the petitioner is unable to attract passengers, who would otherwise have boarded or alighted at the Central Bus Stand. It is contended that this shift in terminal location has adversely impacted the petitioner's ability to secure passenger footfall, particularly, in relation to the route operated between Srirangam and L.I.C. Colony. 5. On the other hand, the learned Special Government Pleader for the respondents submits that only the Town Buses operating with the Central Bus Stand as the terminal have been shifted to the newly constructed Kalaignar Bus Terminus at Panjapur, pursuant to the impugned proceedings dated 14.07.2025. It is further submitted that the petitioner's buses operate between Srirangam and L.I.C. Colony, with L.I.C. Colony as the designated terminus and therefore, there ____________ https://www.mhc.tn.gov.in/judis W.P.(MD)No.21350 of 2025 is no requirement for shifting the petitioner's route to the new bus stand. The request of the petitioner to shift the terminus is thus stated to be unwarranted. 6. Having considered the rival submissions, this Court is of the view that the petitioner appears to be adversely affected due to the shifting of the Central Bus Stand, as the footfall of passengers on the petitioner's route between Srirangam and L.I.C. Colony has been significantly impacted. The said grievance deserves consideration by the first respondent. 7. Accordingly, this Writ Petition is disposed of with a direction to the first respondent to reconsider the decision contained in the impugned proceedings dated 14.07.2025, bearing Reference No.R.No.50337/A2/2024, in the light of the petitioner's representation and grievance and pass appropriate orders within a period of two weeks from the date of receipt of a copy of this order. No costs. Consequently, connected Miscellaneous Petitions are closed.
