Mishra, learned Deputy Solicitor General, appearing for the Union of India/respondent No.1 and Mr. Dhiraj Kumar Wankhede, learned counsel, appearing for respondent No.2 to 5 / NHAI. 2. The present petition has been filed by the petitioner under Article 226 of the Constitution of India with the following prayers:- “10.1 That this Hon'ble Court may kindly pleased to call for the entire records pertaining to the case of the Petitioner available in the office of the Respondents, for its kind perusal. 10.2. That, this Hon’ble Court may kindly be pleased to quash and set aside the show cause notice dated 21.03.2025 (Annexure – P/4) issued by respondent no.4 and declare it illegal and nonest in the eyes of law. 10.3. That, the Hon’ble Court may kindly be pleased to grant any other relief which the Hon’ble Court deems fit and proper in the facts and circumstances of the present case. 10.4. That, the Hon’ble Court may kindly be pleased to grant cost of the petition to the Petitioner.” 3. At the outset, learned counsel for the petitioner submitted that he wants to withdraw the instant petition with liberty to challenge the 3 same before the Courts having exclusive jurisdiction at New Delhi as per Clause 27.f of the Contract Agreement. 4.
