Heard learned counsel for the petitioner and learned A.G.A. for the State. 2. This petition has been filed with the following main prayer: "i. A writ, order or direction in the nature of MANDAMUS commanding the opp. party no. 2 to 3 to transfer the investigation of case crime no. 0451/2025, U/S-109, 115(2), 351(3), 309(6) B.N.S. at P.S.-Kotwali, District- Barabanki to another police of District Barabanki for making free and fair investigation or any other independent agency so that the petitioner could get justice." 3. Learned A.G.A., on the basis of written instructions sent by the Sub Inspector, Police Station Kotwali Nagar, District Barabanki, submits that in this case, Section 110 of B.N.S., 2023 has been added and Sections 109, 309(6) of B.N.S., 2023 have been deleted and Charge Sheet No.491 of 2025 dated 20.7.2025 has been prepared and submitted before the Supervisory Authority for onwards submission to the Court concerned. The said instructions are taken on record. 4. The writ petition has become infructuous. It is accordingly dismissed.
