Heard learned counsel for the applicant and learned A.G.A. This application under Section 483 Cr.P.C./529 of BNSS has been filed for expeditious disposal of petition under Section 12 of the Domestic Violence Act by Mahejubeen Khan @ Mahejubeen, wife of Sarvar Ali, whereas the complaint No.142 of 2022, a copy of which has been annexed as annexure no.1, indicates that the application has been filed by Mahjaveen wife of Sarvar Ali, therefore, the applicant is required to get the name of the applicant corrected before the concerned court first and this application is not maintainable. Even otherwise, this application has been filed for a direction for expeditious disposal of the application. However in this regard the application may be moved before the concerned court pointing out the urgency and statutory provision, if any, which may be considered by the concerned court in view of law laid down by the Hon'ble Supreme Court in the case of High Court Bar Association, Allahabad Versus State of U.P.; 2024(6) SCC 267, in which it has been held that the constitutional courts, in ordinary course, should refrain from fixing a time bound schedule for disposal of cases pending before any other courts unless it is necessary and unavoidable. With the aforesaid, this petition is dismissed. . . .................. .......................................(Rajnish Kumar,J.)
