Neutral Citation No. - 2025:AHC-LKO:44917 Court No. - 7 Case :- CONTEMPT APPLICATION (CIVIL) No. - 2405 of 2025 Applicant :- Anand Pratap Singh Opposite Party :- Shri Bhupendra Singh, Distt. Basic Education Officer Pratapgarg And 3 Others Counsel for Applicant :- Abhishek Singh,Anuj Kumar Gupta Hon'ble Jaspreet Singh,J. Heard Shri Abhishek Singh, learned counsel for the petitioner. The instant contempt petition has been preferred alleging non- compliance of the order passed by the writ Court dated 13.07.1993. The submissions is that since the payment of salary is to be made month after month, accordingly, it is a recurring cause of action, hence, the instant petition, at the behest of the petitioner, is maintainable. Having considered the aforesaid submissions, a specific query was put to the learned counsel for the petitioner that since passing of the order by the writ Court dated 13.07.1993, whether any salary for any month has been paid to the petitioner and if not whether any action was taken by the petitioner before the writ Court. In view of the aforesaid query, it has been stated by the learned counsel for the petitioner that though the writ petition is pending, but neither any application has been made informing the writ Court regarding non-payment of salary nor since July, 1993 any petition for violation has been moved. Taking note of the aforesaid, this Court is of the clear view that if the petitioner could not move an application for more than three decades and as alleged by him that he is working without salary, this Court is not inclined to entertain the petition leaving it open for the petitioner to move an appropriate application before the writ Court. With the aforesaid, the instant contempt petition is dismissed. Order Date :- 4.8.2025 Rakesh/- Digitally signed by :- RAKESH PRAJAPAT High Court of Judicature at Allahabad, Lucknow Bench
