1. Heard learned counsel for the petitioner and the learned AGA for the State-opposite parties no.1 to 3. 2. This writ petition has been filed with the following main prayers:-
“To issue a writ, order direction in the nature of Certiorari thereby quashing impugned first information report dated-03.06.2025 lodged by the opposite party no. 04 in case crime no. 0116 of 2025 under section 3 (1) of U.P. Gangster Act & Anti Social Activities (Prevention) Act 1986, at Police Station Tulsipur, District Balrampur, contained as Annexure No.1 to this Writ Petition. (ii) To issue a writ, order or direction in the nature of mandamus thereby commanding the opp. Party no. 02 & 03 not to arrest the petitioner on the basis of impugned first information report dated 03.06.2025, in the interest of justice.”
3. It has been submitted by the learned counsel for the petitioner that petitioner has been falsely implicated in the impugned First Information Report on the basis of a complaint case lodged by the Forest Department against him. He further submits that petitioner is working as a labourer in District Shilphata, Maharashtra in 2019. 4. Learned counsel for the petitioner has argued on the merits of the predicate offence. We do not find it necessary to make any observation with regard to the merit of the predicate offence. In so far as, a perusal of the First Information Report is concerned, it shows that petitioner is a member of the gang that is involved
in illegal felling of trees and selling of precious wood. Superintendent of Police as well as the District Magistrate has considered the proposal of the Nodal Officer and after application of mind, has granted approval for registration of the First Information Report. Therefore, we do not find any good ground to grant any relief as prayed for. 5. Writ petition is accordingly dismissed. .
