In view of the order proposed to be passed, notice to private respondents is dispensed with. 3. By means of this writ petition, the petitioners have challenged the order dated 30.11.2021 passed by the Deputy Director of Consolidation, Pratapgarh as well as order dated 15.02.2005, passed by Consolidation Officer, Pratapgarh. 4. It has been submitted by learned counsel for the petitioners that the impugned order has been passed on the basis of registered Will of Mahaveer. It is on the basis of the said Will that property has been devolved upon the private respondents. 5. Learned counsel for the petitioners submits that the petitioners on the other hand also challenged the validity of Will filed in the civil court. 6. Accordingly, I further find that no satisfactory explanation has been given for the delay in assailing the order dated 30.11.2021. 7. At this stage, learned counsel for the petitioners submits that she may be directed to withdraw the writ petition with liberty to file a fresh petition after conclusion of the suit proceedings where the validity of Will dated 2.9.1977 is under challenge. 8. Accordingly, subject to the aforesaid liberty, this writ petition is dismissed as not pressed. (Alok Mathur, J.)
