This is an application for granting bail under section 439 of the Code of Criminal Procedure, 1973 in connection with crime No. 281 of 2023 registered with Chalisgaon (Rural) police station, District Jalgaon, for the offences punishable under Sections 307, 498-A of the I.P.C. 2. The informant Nimba Rupchand Wagh lodged a report that the applicant is husband of his sister. On 9.8.2023, he got information that victim Thapabai and the applicant Popat came there on 08.08.2023. When they slept on the platform of the house, the applicant assaulted with a steel pipe of motorcycle shock-up on her head. She sustained serious injuries. She became unconscious. The informant immediately went there. Meanwhile, the applicant was wandering in the village having that steel pipe in his hand. Thereafter, Thapabai was admitted in the Civil Hospital, Dhule. 2025:BHC-AUG:24511 ba693.25 -2- Accordingly, the report was lodged. 3. Learned advocate for the applicant submitted that the applicant is behind bars since two years. He has roots in the society. He will not flee away from the trial. The trial will take a long period. It is lastly prayed to grant bail to the applicant on certain conditions. 4. Learned A.P.P. for the respondent-State has strongly opposed the application and submitted that the applicant is involved in serious crime. He is addicted to liquor and therefore, assaulted his wife on her vital part i.e. head. If he is released on bail, he will certainly pressurize the injured wife and tamper the evidence. It is lastly prayed to reject the application. 5. Perused the charge sheet, particularly the report and the injury certificate of the wife of applicant. She sustained serious injuries to her head. Therefore, sections 307 and 498-A of I.P.C. are invoked against the applicant and the applicant is addicted to the liquor. If he is released on bail, certainly there is possibility of commission of similar nature of crime. He may also pressurize his wife and tamper with the evidence. Conisdering all these aspects, the application deserves to be rejected. The application is therefore, rejected. 6. It is submitted that the applicant is having three children and ba693.25 -3- his wife is also depending upon him. For that purpose, the Legal Services Authority, Soygaon, Tq. Soygaon, district Chhatrapati Sambhajinagar can be directed to provide financial relief with the help of Tahsildar, Soygaon, under various schemes like Eklavya Scheme etc. For that purpose, the Chairman, Legal Services Authority, Soygaon is directed to call the wife of present applicant and her children, to fill up their forms alongwith necessary documents and if necessary the Tahsildar, Soygaon and to provide such financial relief, monthly to the children and wife of the applicant. The Chairman of Legal Services Authority, Soygaon shall report compliance of this order to this Court within two months from today. The wife, who is present in the court, is also orally suggested to visit the office of Legal Services Authority, Soygaon, District Chhatrapati Sambhajinagar, within a week from today. 7. List the matter for report of compliance of above directions, on 17.11.2025. 8. Registrar (Judicial) of this Court to communicate this order to the concerned Legal Services Authority, as early as possible. 9. Parties to act on authenticated copy of this order. (SANJAY A.
