JUSTICE MICHAEL ZOTHANKHUMA ORDER Date : 27-06-2025 Heard Mr. B Pathak, learned counsel for the petitioner, who submits that the petitioner association comprises of authorized LPG distributors operating under the Indian Oil Corporation Limited (IOCL) under the State of Assam. The primary role of the petitioner involves the delivery and release of the LPG connections to beneficiaries under Centrally sponsored schemes, including the Pradhan Mantri Ujjwala Yojana (PMUY), which is a flagship scheme launched in 2017 by the Government of India, with the objective to provide clean cooking fuel to women from economically weaker sections, particularly those identified as Below Poverty Line (BPL) households. 2. The petitioner’s counsel submits that pursuant to implementation of the PMUY, various LPG connections were provided on receipt of applications from the recipients of the scheme. However, the IOCL, vide email dated 25.06.2025, has directed the petitioner to make a re-verification of the identified PMUY customers. The petitioner’s counsel submits that the time limit provided for completion of the re-verification was 30.06.2025, failure of which, would attract penalty as per email dated 25.06.2025. 3. The petitioner’s counsel submits that a reasonable time limit has to be provided by the respondents/IOCL, to enable the petitioner to complete the re- verification process and in that line, an email dated 26.06.2025 was submitted to the IOCL, asking for more time to complete the task required to be undertaken by the petitioner. However, no decision has been made by the IOCL on the petitioner’s email dated 26.06.2025 (Annexure-F). Page No.# 5/5 4. Mr. SS Roy, learned counsel appears for the respondent No. 1. 5. On considering the fact that the IOCL has not taken a decision on the petitioner’s email dated 26.06.2025, for giving more time to complete the re- verification of PMUY customers, this Court is of the view that the respondent No. 5, i.e., The divisional LPG-Sales, Guwahati Indane Divisional Office, Guwahati Indane Divisional Office, Noonmati, Guwahati, Kamrup (Metro), should take a decision on the petitioner’s email dated 26.06.2025. Accordingly, the respondent No. 5 is directed to take a decision on the petitioner’s email, for grant of more time to complete the re-verification process, within a period of 2 (two) weeks from the date of receipt of a certified copy of this order along with a copy of this writ petition. 6. Till then, the impugned communication/email dated 25.06.2205 issued by the respondent No. 5 should not be acted upon. 7. The direction passed above is subject to the condition that the petitioner submits a copy of this order and a copy of the writ petition to the respondent No. 5, i.e., The divisional LPG-Sales, Guwahati Indane Divisional Office, Guwahati Indane Divisional Office, Noonmati, Guwahati, Kamrup (Metro) on or before 30.06.2025. 8.
