Mr. M.C. Pant, Advocate, for the petitioner. Mr. Lalit Samant, Advocate, for the respondents. (2) Petitioner retired as Driver from Uttarakhand Transport Corporation in the year 2023. According to him, he was paid less amount as gratuity and amount of shortfall is more than ₹2,50,000/-. By means of this writ petition, petitioner has sought the following reliefs: “I. Issue a writ, order or direction in the nature of Certiorarified-Mandamus quashing the impugned Office Order dated 17.07.2020 (Annexure No. 1) passed by the Respondents and direct the Respondents to restore the petitioner to the pay fixation, pay scale and service benefits which he was legally entitled to prior to the passing of the impugned order, without revision in pay or any financial penalty or to mould the relief appropriately by safeguarding the interest of the Petitioner keeping in view the facts highlighted in the body of the Petition. II. Issue a writ, order or direction in the nature of Mandamus directing the Respondents to release and pay to the petitioner all consequential and retiral benefits including deducted amount of gratuity, leave encashment, arrears of salary and all other admissible dues along with interest at an appropriate rate or to mould the relief appropriately by safeguarding the interest of the Petitioner keeping in view the facts highlighted in the body of the petition.” 2025:UHC:10855 (3) Mr. Lalit Samant, learned Counsel appearing for Uttarakhand Transport Corporation, submits that if petitioner makes representation, the same shall be considered expeditiously. (4) The writ petition is, accordingly, disposed of with liberty to petitioner to make representation regarding gratuity before the Managing Director of the Corporation. If he makes such representation within two weeks from today, Managing Director shall look into the matter and pass appropriate order, as per law, within four months thereafter.
