The instant writ petition has been filed seeking following main relief:- (a) A decree for the divorce by mutual consent may be passed and dissolved/annulled the marriage of the petitioner, solemnized on 23.11.2023 according to Hindu rites and custom." It is argued that an application for waiving of the cooling off period has already been filed, which is to be considered in the light of judgment rendered in the case of Amit Kumar Vs. Suman Beniwal; (2023) 17 SCC 648. Considering the fact that the application for waiving of the cooling off period has already been filed, the present writ petition is disposed off directing the learned Family Court to decide the aforesaid application for waiving of the cooling off period in the light of the judgment rendered in the case of Amit Kumar (Supra) within a period of six weeks from the date of filing of the application.
