This writ petition has been filed under Article 226 of the Constitution of India by the petitioners for protection from respondent nos.4 to 8, who happens to be the near relatives of late husband of petitioner no.1 – Smt. Rajo Bai. 4. It is contended in the writ petition that the petitioners solemnized marriage and respondent nos.4 to 8 are annoyed of the marriage being the near relatives of the late husband of Smt. Rajo Bai i.e. Late Kulwant Singh. 5. Both the parties are present before this Court and on interaction they admitted the fact of their marriage out of their own sweet will. Hence no one can interfere in their matrimonial alliance. 6. From perusal of the record, it is revealed that both the parties are major, moreover the petitioner no.1 – Smt. Rajo Bai is a widow, whose husband expired on 11.03.2020. Death certificate of the late husband is annexed with the writ petition and some photographs in support of their marriage are also annexed. 7. Since petitioners are major and voluntarily living together after marriage, therefore, this Court is inclined to grant protection to the petitioners, in view of the law laid down by Hon’ble Supreme Court, in the case of Lata Singh Vs. State of U.P. and another 2006 (5) SCC 475. 8. Writ petition is accordingly disposed off with a direction to respondent no.3 - S.H.O. Police Station Bazpur, District Udham Singh Nagar, to provide protection to the petitioners for a period of six weeks, to ensure that no harm is caused to them. 2025:UHC:646 Upon expiry of six weeks, S.H.O concerned shall make fresh assessment of threat perception to the petitioners and take such measures as are felt necessary, for safety of the petitioners.
