Heard learned counsel for the applicants, learned A.G.A. for the State and perused the record. The instant application under section 482 Cr.P.C. has been filed by the applicants for quashing the warrant of arrest (NBW) issued via order dated 10.7.2025 by the court of Chief Judicial Magistrate, Court No.10, Gonda against the applicants in Criminal Case No.30846 of 2024 arising out of FIR No.928/2023 under Section 147, 149, 308, 452, 323, 504, 506, 427, 325, 336 I.P.C. Police Station Kotwali Nagar, District Gonda. It is further submitted that non-appearance before the court below is not deliberate but it had happened due to unavoidable circumstances. Learned counsel for the applicants submits that the applicants undertake that they will not further jump the conditions of bail and will remain present on each and every date fixed by the court below. Learned counsel further undertakes that the applicants will appear before the court below within a period of 15 days and apply for bail. In view of the aforesaid submissions, for the period of 15 days, non bailable warrant dated 10.7.2025 issued against the applicants shall remain stayed. However, if the applicants do not appear before the court below within the aforesaid period, this order shall stand revoked and no benefit of this order shall accrue to them.
