Heard learned counsel for the appellant as well as Sri Alok Kumar Tripathi, learned counsel who has filed his vakalatnama for the respondents no.2, the same is taken on record who has submitted that the instant appeal is no more maintainable before this Court in terms of the proviso appended to Section 83(2) of The Unified Waqf Management, Empowerment, Efficiency and Development Act, 1995. 2. It is informed that on 02nd August, 2025, this Court on the administrative side has already appointed the Chairman of the U.P. Waqf Tribunal and in this view of the matter, the appellants can file an appeal before the Tribunal. 3. This position is not disputed by the appellants. 4. In view thereof, the present appeal is permitted to be withdrawn by the appellants to be filed before the Waqf Tribunal which needless to say shall be considered and decided on its own merits.
