Neutral Citation No. - 2025:AHC-LKO:44154 Court No. - 5 Case :- WRIT - A No. - 8397 of 2025 Petitioner :- Pravesh Kumar Tiwari Respondent :- State Of U.P. Thru. Prin. Secy. Deptt. Forest Lko. And 3 Others Counsel for Petitioner :- Sanjeev Kumar Pandey,Ram Alok Singh Counsel for Respondent :- C.S.C. Hon'ble Abdul Moin,J.
1. Heard learned counsel for the petitioner and Ms. Parul Bajpai, learned Additional Chief Standing Counsel appearing for all the respondents.
2. With the consent of learned counsel for the parties, the instant writ petition is being finally decided.
3. The contention of learned counsel for the petitioner is that the Hon'ble Supreme Court, in the case of Sabha Shanker Dube vs. Divisional Forest Officer and others, passed in Civil Appeal No.10956 of 2018, decided on 14.11.2018, has held that a person working on a temporary basis would be entitled to be given the minimum pay scale as long as he continued in service.
4. The further contention is that once the Hon'ble Supreme Court has decided the aforesaid issue, consequently, there cannot be any occasion for the respondent to not pay the minimum pay scale
to the petitioner, more particularly considering the long period of service rendered since the year 2012 and the fact that he continues to work on daily wages.
5. Accordingly, considering the aforesaid, the writ petition is disposed of with a direction to the respondent No.3, Divisional Forest Officer, Amethi to consider the case of the petitioner for grant of minimum pay scale keeping in view the judgment of the Hon'ble Supreme Court in the case of Sabha Shanker Dube (supra).
6. Let such consideration be made within a period of two months from the date of receipt of a certified copy of this order. [Abdul Moin, J.] Order Date :- 30.7.2025 cks/- Digitally signed by :- CHANDRA KANT SINGH High Court of Judicature at Allahabad, Lucknow Bench
