Heard learned counsel for the petitioner, Shri Suresh Kumar Pandey, learned counsel appearing for respondents no.6 to 10 as well learned Standing Counsel for the State-respondent and perused the material brought on record. 2. The present petition has been filed by the petitioner with the following prayer: "(i) Issue a writ, order or direction in the nature of mandamus thereby directing the opposite party no.1 to 4 to take the necessary actions for removal of the illegal encroachment over the gata no.223/0.0550 hectar reserved for primary school, gata no.224 recoded as play Ground, Gata No. 159/0.0330 hec for fertilizers pit, Gata No. 161to 164 for Naveen Parti and Gata No. 146/0.140 hec for Naveen Parti in the revenue record situated in Ali Nagra, Pargana -& Tahasil -Ikuana, Distt. -Shrawasti and also to take necessary action against them for their illegal encroachment." 3. Learned Standing Counsel, based upon instructions states that the proceedings under Section 67 of the U.P Revenue Code have been initiated and are pending. 4. In view of the said statement, the present petition is disposed of with a direction to the authority concerned to conclude the aforesaid proceedings with all expedition within the time, as prescribed in the statute i.e. 90 days, in accordance with law.
