JUSTICE SANJAY KUMAR MEDHI ORDER 19.09.2025 When this matter had come up for consideration yesterday, i.e. on 18.09.2025, the following order was passed: “Heard Shri D. Chutia, learned counsel for the petitioner, who has submitted that as per instructions, the connected criminal case which was instituted has been withdrawn and therefore, there may not be any basis to continue with the confiscation. Shri I. Borthakur, learned Standing Counsel, Forest Department prays for and is granted a days’ time to obtain instructions. List this case for consideration tomorrow i.e. 19.09.2025.” Shri D. Gogoi, learned Standing Counsel, Forest Department has confirmed that the Criminal case which was instituted in connection with which the present confiscation was done has been withdrawn. The challenge in this petition was with regard to an order dated 01.03.2021 passed by the DFO in Confiscation Proceeding No. DH/12 of 2020-21, DVL/24 of 2020-21. Since the connected criminal case has been withdrawn, this Court is of the opinion that the confiscation which was the subject matter of challenge would automatically fall through.
