Learned counsel for the petitioner submits that the petitioner purchased the property in question through auction from the bank. The property belonged to the private respondent who took loan from the bank and on his inability to pay the same the property was taken possession of by the bank and sold out to the petitioner by way of auction. The petitioner alleges that the private respondent is disturbing the peaceful possession of the petitioner therein and is demanding an amount of Rs.2 crores from him. Complaint lodged by the petitioner before the police authority in this regard has not been acted upon. It appears from the report submitted by the State that pursuant to the complaint lodged by the petitioner, preliminary enquiry is being conducted upon registration of 2 a preliminary enquiry case being PE no.155 of 2025 dated 12th November, 2025. No fruitful purpose shall be served in keeping the writ petition pending. The police authority is directed to conduct the preliminary enquiry in a proper and unbiased manner and take the same to its logical conclusion in accordance with law. The writ petition is disposed of. However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
