The petitioner apprehending her arrest in connection with Simariya PS Case No. 51 of 2025 for the offences registered under Sections 89, 91, 125, 221, 289, 318(2), 319(2), 338, 341(1), 336(3) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and under Section 41 of the Clinical Establishment (Registration and Regulation) Act, has prayed for grant of anticipatory bail.

Learned counsel for the petitioner submits that the petitioner has committed no offence and she has falsely been implicated in this case. He submits that the petitioner is a government employee and posted as an ANM at Ayushman Arogya Mandir, Dadi, Chatra. He further submits that on 21.03.2025 the petitioner was on duty at Ayushman Arogya Mandir, Dadi which has also been verified by the investigating officer of this case. He lastly submits that the petitioner has got no criminal antecedent as such, she may be enlarged on anticipatory bail.

Learned APP opposes the prayer for grant of anticipatory bail to the petitioner.

Having heard learned counsel for the parties and

considering the materials available on record, I am inclined to enlarge the petitioner on anticipatory bail and accordingly, the petitioner, above- named, in the event of her arrest or surrender before the Court below within four weeks from today, shall be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Chatra in connection with Simariya PS Case No. 51 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023.
